1. Scope of Application
These terms and conditions apply to all business relationships between Synouvelle Cosmeceuticals Black Flamingo e.U., hereinafter referred to as "Synouvelle Cosmeceuticals", and persons (consumers) who wish to make a purchase from Synouvelle Cosmeceuticals. The following conditions apply to all orders placed in writing, by telephone or on the Internet, and are acknowledged with each order. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business, or profession.
2. Offer and Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. Errors reserved.
2.2 By clicking the "Buy now" button, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving your order.
3. Right of Withdrawal, Withdrawal Instruction
If you are a consumer, you have the following right of withdrawal:

You have the right to withdraw from the contract within 14 days without giving any reason in writing (e.g. letter, fax, email) or – if the item is delivered before the deadline – also by returning the item. The withdrawal period begins after receipt of this instruction in writing, but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our obligations under Article 246 § 2 in connection with § 1 paragraphs 1 and 2 of the Introductory Act to the German Civil Code (EGBGB) as well as our obligations under § 312g paragraph 1 sentence 1 BGB in connection with Article 246 § 3 EGBGB. Consequences of revocation
benefits of use), or are only able to do so in part or in a deteriorated condition, you must compensate us for the loss of value. You only have to pay compensation for the deterioration of the goods and for the use made of them if the use or the deterioration is due to the handling of the goods which goes beyond the examination of the characteristics and the functioning. By "testing the properties and functionality" we mean testing and trying out the respective goods, as is possible and customary in a shop, for example. Goods that can be sent by parcel post are to be returned at our risk. You have to bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for you. Items that cannot be sent by parcel post will be collected from you. Obligations to refund payments must be fulfilled within 30 days. For you, the period begins with the dispatch of your notice of cancellation or the item, for us with its receipt.

3a. Return Costs When Exercising the Right of Withdrawal
If you make use of your legal right of withdrawal (see withdrawal instructions), you will have to bear the regular costs of the return shipment if the delivered goods correspond to the ordered ones and if the price of the item to be returned does not exceed 40 euros or if, in case of a higher price, you have not yet provided the consideration or a contractually agreed partial payment at the time of withdrawal. Otherwise, the return shipment is free of charge for you.
4. Prices and Shipping Costs
4.1 The prices indicated by Synouvelle Cosmeceuticals are in EURO and include the applicable value-added tax specific to the product. Errors and short-term price changes are reserved. The prices indicated on the Internet at the time of the order are applicable for the ordered items.
4.2 Any shipping costs that may apply will be indicated in the order form. If shipping costs are not indicated in the order form, shipping will be free of charge.
5. Delivery
The delivery is made exclusively as an insured package. Normally, the goods will be dispatched within 1-3 days after receipt of payment or order. In peak periods, it may take up to 6 days. Liability for delayed delivery is excluded. Partial deliveries, if reasonable for the customer, are permissible. Any additional shipping costs incurred will be borne by Synouvelle Cosmeceuticals.
6. Payment
In our shop, the following payment options are available:

We reserve the right to exclude individual payment methods.
6.1. When paying by credit card (VISA, Mastercard, Maestro, Amex), you will provide us with your credit card information when placing your order. After completing the credit card payment, the goods will be immediately released for shipping. Your credit card account will be charged upon completion of the order and your verification as the rightful credit card holder.
6.2. When paying with PayPal, you will be redirected from the order process to the PayPal website. Payment with PayPal is only possible if you are registered with PayPal or register for an account. You will then be redirected to the payment page and confirm the payment instruction to us. Your bank or credit card details are always securely stored with PayPal. They will not be transmitted to us during the payment process. After placing your order, we will request PayPal to initiate the payment transaction, which will be processed automatically.
6.3. When paying with "Invoice with Klarna", Klarna (www.klarna.com, Klarna Bank AB, Sveavägen 46, 111 34 Stockholm) checks your creditworthiness to determine whether an invoice payment can be offered to you. If an invoice payment is possible for you, you will receive an invoice from Klarna with the corresponding payment instructions. When purchasing on invoice with Klarna, you always receive the goods first and have a payment period of 14 days. We assign our payment claim to Klarna. Only Klarna can have a performance-liberating effect. 6.4. When paying with "Pay immediately with Klarna", you will be redirected to the website of the online provider Sofort GmbH after placing your order. You will need to select your bank, log in with your online banking details, and authorize the transaction with a TAN. The charge will be made immediately after you place your order. We assign our payment claim to Klarna (Klarna Bank AB, Sveavägen 46, 111 34 Stockholm). Only Klarna can have a performance-liberating effect.
6.5. With a payment via EPS transfer, a central list of participating banks (Austria & Germany) opens after selecting the payment method, from which you can select your bank. Then, in the login window of your online banking, you enter your login details and carry out the transfer immediately using a TAN. No registration is required for a payment with EPS transfer.
6.6. When paying with Apple Pay or Google Pay, you initiate the payment transaction using your smartphone or wearable device. To use Apple Pay, you must be registered with Apple and have the "Apple Pay" feature activated. After selecting the payment method, you enter your access data for your Apple account to authenticate yourself. Then, you confirm the payment instruction for the payment using a payment method you have stored with Apple (credit card or debit card) to us. The payment is made immediately after placing the order. To use Google Pay, you must be registered with Google Pay. After selecting the Google Pay payment method, you enter your access data and confirm the payment using a payment method you have stored with Google (credit card or debit card). The transaction is made immediately after placing the order.
6.7. For payment by advance payment/bank transfer, you will receive an order confirmation by email from us after completing your order, including all the necessary information for the transfer. You transfer the total amount of your order with the order reference. Once the amount is credited to our account, we will ship your order. The order will be automatically cancelled if no payment is received within 10 days.
7. Reservation of title
The goods remain the property of *Synouvelle Cosmeceuticals* Black Flamingo e.U., Bachstraße 75, A-5023 Salzburg, until full payment has been received.
8. Rejection of Orders
Synouvelle Cosmeceuticals reserves the right to refuse an order without giving reasons. If an order is not executed, the purchaser will be informed.
9. Data Protection
All personal customer data will be treated with absolute confidentiality by Synouvelle Cosmeceuticals and will not be passed on to third parties. The data necessary for business transactions will be stored. Your data will only be processed for order processing and for maintaining the ongoing customer relationship, including electronically. Objection is possible at any time. Please notify us accordingly.

All contents of the webshop of Synouvelle Cosmeceuticals have been carefully reviewed. However, no guarantee can be given for the correctness, completeness, and timeliness of the information provided. Any liability of Synouvelle Cosmeceuticals for content of external websites linked to is excluded. All texts, graphics and images are subject to copyright. Use is only permitted with the express permission of the rights holder.

Austrian law applies, with the exclusion of the UN Sales Convention.
